Why Maya Forstater will lose her appeal

Maya Forstater was employed by the Center for Global Development, her contract was at the end and they decided not to renew her contract. The reasons given for doing this were due to her social media posts. If you read her twitter feed you will see that she is a very outspoken gender critical “feminist” and the company decided that to have such a person working for them and representing them was not a positive thing to do. So they did not renew her contract when it expired.

This like many people upset her and as a result she took the company to an employment tribunal claiming that this was discrimination against her. The basis of her appeal relied upon section 10 of the Equality Act, that Religion an belief are a protected characteristic.

The origin of S.10 was to protect religion and people who don’t hold religious belief. So that along with the other listed things a company could not discriminate. But in previous cases this has been expanded through case law to include political beliefs and other belief systems that people might hold rightfully. Her claim was that gender critical views should also be included in this thought system.
